This legal notice governs the use of academy.danielalfocea.com (hereinafter, «the platform»). Read it before using it: by browsing it you accept what it says.

The courses, books, audios and other content are created and signed by Daniel Alfocea. The one who sells, invoices and answers to you is Alice & Bob, S.L.

2. What this website is for

The platform sells and delivers online training: courses, masterclasses, books in EPUB and PDF, audios and documents, as well as packs and paths that group several of them. Part of the catalogue is free and part is paid.

The terms of purchase are in the terms and conditions of sale, and the processing of your personal data is in the privacy policy. The three documents are read together.

3. How the platform is used

By using the platform you undertake to:

  • Give truthful data when creating your account, and keep it up to date.
  • Use your account yourself and only yourself. The account is personal and non-transferable: it is not lent, shared or sold. The platform limits the number of sessions and devices, and detects shared accounts; the detail is in the terms and conditions of sale.
  • Not try to get around the technical measures that protect the content (watermarks, signed links, stamping of downloadable files).
  • Not copy, download, redistribute, resell or publish the content, whole or in part.
  • Not use the platform for anything illegal, or to bother or harm other people.
  • Not overload the platform with automated requests beyond what the API and the official tools allow.

If you break these rules we may block your account. When we do, we will tell you why, by email, and you can reply to that same email to dispute it.

4. Who owns the content

Everything on the platform —texts, videos, audios, books, documents, sample code, images, brand, design and the software itself— is protected by intellectual and industrial property law. It belongs to Alice & Bob, S.L. or to whoever has authorised us to use it.

Buying a product does not transfer any rights over it to you: it gives you a licence for personal use, on the terms of the terms and conditions of sale. Any other use needs our written permission.

The page of each product always says who signs it, whether Daniel Alfocea or another teacher.

Daniel Alfocea, as a natural person, assigns to Alice & Bob, S.L. the exploitation rights over his image, his voice and the content he signs, in an assignment signed in writing between the two. Each teacher other than Daniel Alfocea has signed with Alice & Bob, S.L. a licence of use over their content, and none of their courses is published without it. That licence obliges the teacher to guarantee that they own what they license and to keep it in force while the course remains published in the catalogue, and it does not allow them to withdraw it with effect on enrolments already sold: whoever has already bought the course keeps their access even if the teacher stops working with the platform.

Some catalogue pages link to third-party stores, for example Amazon, to buy there a book that is not sold here. Those links leave our website: what happens on the destination site —price, shipping, returns, data— is governed by its own terms, not by these. We are not responsible for the content of websites we do not control.

6. Availability and liability

We use reasonable means to make the platform work, be available and be free of errors, but we cannot guarantee that it will never go down or that it will have no faults. Nor are we liable for damage caused by problems with your connection, your equipment or third-party services outside our control.

Where the law allows, our liability for the use of the platform —apart from that which applies to the products you buy, regulated in the terms and conditions of sale— is limited to direct and foreseeable damage, and is excluded for indirect damage, loss of profit or loss of data that do not depend on a breach on our part.

Nothing above limits the liability that the law imposes on us towards consumers in a mandatory way, nor excludes liability for wilful misconduct or gross negligence, which the law does not allow to be limited.

7. Changes to this notice

We may change this legal notice when the platform or the regulations change. The version in force is always the one published here, with its date at the foot. Changes that affect a contract already signed are governed by what the terms and conditions of sale say.

8. Governing law and courts

This legal notice is governed by Spanish law.

If you are a consumer and live in the European Union, you can bring claims against us before the courts of your own domicile or before those of the city of Madrid, at your choice; we can only bring claims against you before the courts of your domicile, in accordance with Regulation (EU) 1215/2012. If you live outside the European Union, the rules on international jurisdiction that apply according to your country of residence apply.

If you contract as a company or professional, the parties expressly submit to the courts of the city of Madrid, waiving any other jurisdiction that might correspond to them.
